ความไม่ชอบธรรมผิดหลักกฎหมายในการตั้งข้อกล่าวหาพระเทพญาณมหามุนี

การดำเนินคดีแจ้งข้อกล่าวหาแก่พระเทพญาณมหามุนี  ว่าสมคบกันฟอกเงินและรับของโจร ในคดีพิเศษที่ 27/2559 เป็นการสอบสวนที่ไม่ชอบด้วยกฎหมาย ด้วยเหตุผลดังนี้
In accordance with special case no. 27/2559, Phrathepyanmahamuni was unjustly charged with abetting in money laundering and accepting stolen property.

特别调查案件27/2559一案，本寺住持法胜法师被不公检控涉嫌协助洗钱及收受赃款。

1.   กรณีสหกรณ์เครดิตยูเนี่ยนคลองจั่น ซึ่งมีการนำเงินออกไปโดยเช็ค 878 ฉบับ จนสหกรณ์ฯประสบปัญหาทางการเงิน ทางดีเอสไอดำเนินการสอบสวนในคดีพิเศษที่ 146/2556 และได้ส่งสำนวนสอบสวนไปยังอัยการแล้ว โดยไม่มีพระเทพญาณมหามุนีอยู่ในฐานะผู้ต้องหา ซึ่งหลักกฎหมายมีอยู่ว่า  มูลคดีใดที่พนักงานสอบสวนส่งสำนวนไปยังอัยการแล้ว อำนาจในการพิจารณาสั่งคดีจะอยู่ที่อัยการ พนักงานสอบสวนจะไปสอบสวนและตั้งข้อหาบุคคลอื่นอีกในมูลคดีเดิมนั้นเพิ่มโดยพลการไม่ได้ (ตามประมวลกฎหมายวิธีพิจารณาความอาญา มาตรา 141-143)
1.  In reference to the Klongchan Credit Union Cooperative (KCUC) case where 878 checks had been withdrawn which led to the problems related to their financial operations, the Department of Special Investigation (DSI) started with special case no. 146/2556, which they had submitted to the prosecutor with Phrathepyanmahamuni as a suspect. By law, once the findings by the DSI officials are submitted to the prosecutor, the authority to evaluate, or to further investigate, rests in the hands of the prosecutor. DSI officials are not permitted to investigate further and charge an additional individual using the same findings at this stage according to criminal code 141-143.
1. 关于空赞信用合作社一案（案件号146/2556），特别调查厅（DSI）所主力调查导致该案之878张涉案支票，其中涉及法胜法师，故此特别调查厅（DSI）调查完毕将案件呈送检控部门时将法胜法师列位涉案嫌疑人。依据泰国刑事检控法141-143条规定，特别调查厅调查完毕并完整呈交检控部门后，当由检控官员负责权衡检控，或决定进行深入调查。特别调查厅（DSI）不得自行再介入调查，更不得擅自在已呈交检控之案件内增加涉嫌被告

2.   ต่อมาทางอัยการได้สั่งให้พนักงานสอบสวนคดีพิเศษไปสอบสวนเพิ่มเติม ในมูลคดีเกี่ยวกับเส้นทางการเงินของเช็คจำนวน 878 ฉบับ ซึ่งในจำนวนนี้พนักงานสอบสวนได้มาสอบปากคำพระเทพญาณมหามุนีกรณีรับเช็คสหกรณ์คลองจั่น จากนายศุภชัย จำนวน 10 ฉบับ และพนักงานสอบสวนคดีพิเศษได้รวบรวมสำนวนการสอบสวนเพิ่มเติมทั้งหมดในคดี 146/2556นี้ ส่งไปให้อัยการเมื่อวันที่ 29 ตุลาคม 2558  และเสนอให้ทางอัยการสั่งตั้งข้อหาสมคบกันฟอกเงินและรับของโจรแก่พระเทพญาณมหามุนี
2. Later, the prosecutor requested that DSI officials obtain additional evidence related to the money trail for the 878 checks. DSI officials have already questioned Phrathepyanmahamuni about his role as a recipient of the 10 checks from the Credit Union as authorized by Mr. Supachai. DSI officials then submitted their additional findings related to special case no. 146/2556 on the 29th of October 2015, and recommended the prosecutor bring charges of money laundering and accepting stolen goods against Phrathepyanmahamuni.
2.呈交案件之后，检控官指示特别调查厅（DSI）对878张支票涉及金额之去向作更深入取证。此时特别调查厅（DSI）已经传讯法胜法师对曾收受10张支票作出解释。（全案涉及由被告人Mr. Supachai 授权空赞信用合作社开具之支票总数为878张，而其中仅10张给予法胜法师。）特别调查厅（DSI）人员乃借此机会于2015年10月29日将法胜法师增加为同146/2556一案中洗钱及收受赃款之嫌疑人。

3.   ทางอัยการได้พิจารณาสั่งคดีที่ 146/2556 เมื่อวันที่ 29 มกราคม พ.ศ.2559 โดยไม่สั่งฟ้องพระเทพญาณมหามุนี มีคำสั่งเพียงว่า หากปรากฏพยานหลักฐานว่ามีบุคคลอื่นร่วมสมคบหรือสนับสนุนการกระทำผิด  ก็ให้พนักงานสอบสวนดำเนินการตามอำนาจหน้าที่ตามกฎหมายต่อไป
3. The lead prosecutor reviewed case no. 146/2556 on the 29th of January 2016, without charging Phrathepyanmahamuni. If evidence emerged showing there were individuals who conspired to engage in this crime, then investigative officials were permitted to proceed with the case in accordance with the law. 
3.146/2556一案，经首席检察官审视后，于2016年1月29日决定对法胜法师不予检控。首席检察官指出，除非有证据证明涉案嫌疑人有串谋进行违法行动者，负责调查人员方准许依法对案提出检控。

4.   ทางพนักงานสอบสวนคดีพิเศษได้นัดหมายแถลงข่าวว่าจะตั้งข้อหารับของโจรกับพระเทพญาณมหามุนีในวันที่ 18 กุมภาพันธ์ พ.ศ. 2559 ทางทนายความผู้รับมอบอำนาจของพระเทพญาณมหามุนี  จึงได้ทำหนังสือสอบถามทางอัยการว่า ทางพนักงานสอบสวนคดีพิเศษมีอำนาจแยกคดีตั้งข้อหาเองในกรณีนี้หรือไม่ ได้รับคำตอบจากอัยการว่า ในกรณีนี้พนักงานสอบสวนคดีพิเศษ จะต้องทำการสอบสวนหาพยานหลักฐานเพิ่มเติมแล้วส่งมาให้ทางอัยการพิจารณาสั่ง จะไปแยกคดีตั้งข้อหาเองไม่ได้
4. On the 18th of February 2016, DSI officials released a public statement that they would charge Phrathepyanmahamuni for accepting stolen property. The attorney representing Phrathepyanmahamuni filed a letter to the prosecutor asking if DSI officials were authorized to bring this additional charge. The prosecutor stated that DSI officials will have to obtain additional evidence and submit these findings to the prosecutor first. DSI officials cannot legally construct a new case on their own. 

           4.2016年2月18日，特别调查厅（DSI）向公众宣布该厅将对法胜法师提出收受赃款之控诉。法胜法师之代表律师当即向检控官提交书面询问特别调查厅（DSI）是否有检控官授权作此控诉。检控官当时书面回复称，特别调查厅DSI）必须先行向检控部门提供进一步证据方可获得授权，特别调查厅（DSI）不得非法另行提出控诉。

5. ทางทนายความผู้รับมอบอำนาจได้ทำหนังสือแจ้งคำตอบของทางอัยการ ให้กับอธิบดีกรมสอบสวนคดีพิเศษทราบเมื่อวันที่ 18 กุมภาพันธ์ พ.ศ.2559
5. The attorney, who was given Power of Attorney by Phrathepyanmahamuni, submitted documentation with responses from the Lead Prosecutor, to the Director-General of DSI on the 18th of February 2016. 
5.法胜法师之授权代表律师于2016年2月18日将检控官之书面回复及相关文件递交特别调查厅（DSI）厅长。

6.   การที่นายธรรมนูญ อัตโชติ ได้มาแจ้งความกล่าวโทษพระเทพญาณมหามุนีในข้อหาสมคบกันฟอกเงิน และร่วมกันรับของโจร เมื่อเดือนมีนาคม พ.ศ.2559 และพนักงานสอบสวนคดีพิเศษ ตั้งเป็นคดีที่ 27/2559 ขึ้น แล้วออกหมายเรียกเมื่อวันที่ 29 มีนาคม ให้พระเทพญาณมหามุนีไปพบในฐานะผู้ต้องหาสมคบกันฟอกเงินและรับของโจร  จึงอาจเป็นการปฏิบัติหน้าที่โดยมิชอบ ( ตามนัยคำพิพากษาฎีกา ที่ 9/2481 )
6. Mr. Thammanoon Attachoti filed a complaint against Phrathepyanamahamuni alleging he was an accomplice in laundering money and accepting stolenproperty in March 2016, which led DSI officials to open special case No. 27/2559. DSI officials then issued a summons on the 29th of March for Phrathepyanmahamuni to appear as the accused in conspiring to launder money and accept stolen property, which may be considered a misuse of authority (according to Judgement No. 9/2481). 
6.2016年3月，Mr. Thammanoon Attachoti 提出投诉，指责法胜法师涉嫌同谋洗钱及收受赃款。特别调查厅（DSI）借此另立特别案件27/2559一案。特别调查厅（DSI）并于2016年3月29日，违反审判书9/2481号之判决，对法胜法师以涉嫌洗钱及收受赃款发出传票。

7.   นายพัฐจักร เทพษร ศิษยานุศิษย์ของวัดพระธรรมกายได้ไปกล่าวโทษต่อ ปปช. ว่าพนักงานสอบสวนคดีพิเศษในคดีที่ 27/2559 นี้เป็นเจ้าพนักงานปฏิบัติหน้าที่โดยมิชอบ ผิดประมวลกฎหมายอาญามาตรา 157 มาตรา 200 มาตรา 83 มาตรา 86 แล้ว เมื่อวันที่ 16 พฤษภาคม พ.ศ. 2559 และกล่าวโทษนายธรรมนูญ อัตโชติ ในฐานะเป็นผู้สนับสนุนในการกระทำความผิด
7. On the 16th of May 2016, Mr. Pathajak Thepsorn, a supporter of Wat Phra Dhammakaya, filed a complaint to the Office on Anti-Corruption Commission that DSI officials in special case no. 27/2557 had performed their duties dishonestly. They had broken Criminal Code Article 157 Sections 200, 83, and 86. He also filed a complaint against Mr. Thammanoon Attachoti as being the person behind these illegal activities.
7.2016年5月16日，法身寺信众Mr. Pathajak Thepsorn在反腐局报案，投诉特别调查厅（DSI）在27/2559一案中采取不诚实手段，并同时投诉Mr. Thammanoon Attachoti为此一非法行为之幕后始作俑者。

8.   กระบวนการสอบสวนของพนักงานสอบสวนคดีพิเศษ ในคดีที่ 27/2559 นี้ มีความไม่ชอบธรรมหลายประการ อาทิ มีการตั้งข้อหาคดีพิเศษและออกหมายเรียกเป็นผู้ต้องหาอย่างรวดเร็ว เมื่อพระเทพญาณมหามุนีขอเลื่อนการพบพนักงานสอบสวนด้วยเหตุอาพาธ โดยมีใบรับรองแพทย์จากทั้งคลินิกและโรงพยาบาลของรัฐไปแสดง แต่พนักงานสอบสวนกลับไม่อนุญาต โดยไม่มีการให้แพทย์จากหน่วยงานกลางมาตรวจอาการ ว่าท่านป่วยจริงหรือไม่ แต่ไปขอศาลออกหมายจับเลย
8. The investigation carried out by DSI officials for special case no. 27/2559 is unjust on many accounts; for example, They rapidly opened a new case and subsequently issued a summons for the accused. Phrathepyanmahamuni had requested a postponement due to illness, with a medical certificate from clinic-based and public hospital-based physicians as supporting documentation. However, DSI officials did not permit the postponement and did not assign a physician from the government sector to examine his health, as to whether he is indeed ill or not. Instead, they immediately sought an arrest warrant from the court.
8. 特别调查厅（DSI）在特案27/2559 一案中，多方面采取不公正手段。 例如，匆忙另行立案并对涉嫌人出具传票。法胜法师出具注册医院之合法医务人员所开具之医疗证明，以健康不佳为由要求延期应讯，但特别调查厅（DSI）在并未指派医务人员验证之情况下予以拒绝。并向法庭申请逮捕。

9. คณะศิษยานุศิษย์มีข้อสงสัยว่า การตั้งคดีที่ 27/2559 ของทางดีเอสไอน่าจะไม่ถูกต้อง  ผิดหลักกฎหมายมาตั้งแต่ต้น จึงไม่มีความชอบธรรมในการดำเนินคดี  เหมือนกลัดกระดุมเม็ดแรกผิด เม็ดต่อๆ มาก็ผิดไปหมด
9. Supporters and followers of Wat Phra Dhammakaya question the basis of special case no. 27/2559 by the Department of Special Investigation and believe that it was illegal to begin with. Thus, the judicial process was not carried out in a fair and honest manner. This is akin to buttoning up the first button on a shirt in the wrong position. The rest will be in the wrong position as well. 

          9. 法身寺信众对特别调查厅（DSI）27/2559一案怀疑该厅严重违法，导致司法程序有失公允并欠诚实。更由于起步之错误延伸导致其后所有之进程一再延续错误。法身寺信众呼吁各界正视该案所涉及之一切错误、违法及滥用职权情形，为社会公理及全国人民日后获得公正裁决作出努力。

คณะศิษยานุศิษย์จึงจะแจ้งความดำเนินคดีผู้เกี่ยวข้องกับคดีนี้ทุกคนที่ปฏิบัติหน้าที่โดยมิชอบ เพื่อมิให้เจ้าพนักงานลุแก่อำนาจ ปฏิบัติหน้าที่ตามอำเภอใจ เป็นการสร้างมาตรฐานความถูกต้องชอบธรรมทางกฎหมายให้เกิดขึ้นแก่สังคมต่อไป
Supporters and followers would like to bring attention to every illegal action committed by each person involved with this case, in an attempt to prevent authorities from abusing their power. They should act justly, and in accordance with the law, in order to set proper standards for the rest of society.
